By placing an order for customized products with Beyond Your Branding, LLC or on beyondyourbranding.com you agree to the terms and conditions outlined below.

Order Processing and Production

1. Custom Product Orders: Once an order for custom products is placed, it is immediately sent to production where components, raw materials, blank apparel, and other necessary items are sourced and sent to our decoration facility or fulfilled by one of our many print partners across North America.

2. Cancellation Policy: Due to the nature of custom products, we cannot always cancel an order once it has been placed. The scope of sourcing materials and starting the production process makes cancellations challenging. If a cancellation is possible, it may be subject to a 50% restocking fee and additional cancellation fees.

Design and Artwork

3. Design Approval and Issues:

Orders placed directly with our design team for approval or those that selected our Print-Ready Artwork Service are eligible for review. If there is an issue with the printing, we are happy to replace the product or provide a credit where deemed necessary.

Orders placed through our virtual design tool without adding the Print-Ready Artwork Service will not be eligible for a refund due to issues such as low-quality artwork, blurry images, or incorrect color conversions (e.g., RGB to CMYK/Pantone/spot color).

4. Quality Assurance: We stand behind our products 100%. If a product is found to be defective (e.g., missing components, damaged products), please contact us for a replacement or credit.

Delivery and Shipping

5. Delivery Dates: We always strive to meet your deadlines; however, during peak times such as holidays, carriers may not always deliver ground shipping orders on time. We recommend selecting expedited shipping options during these periods to ensure timely delivery.

6. Act of God Clause: Beyond Your Branding, LLC is not responsible for delays or failures in performance resulting from acts of God, such as natural disasters, pandemics, government restrictions, or other circumstances beyond our control.

Warranty and Returns

7. Product Defects and Returns: Since products are custom-made to order, we do not accept returns or exchanges. However, we can usually assist with a replacement or credit. Customers take ownership of the order upon receipt and must notify us within 72 hours by emailing [email protected] along with photos of the products and their issues. Our Customer Service Representative will document your complaint and create a claim for you to reference as we investigate how to best resolve the issue. All defects and/or order issues must be reported within 72 hours of receiving your order. Customers will be requested to submit digital photos to document the product’s defects. In some cases, customers may be required to ship defective products back to Beyond Your Branding, LLC at their own expense within an agreed-upon reasonable time frame. If a defect is determined to exist, we may reimburse the customer for shipping.

8. Expedited Orders: Any charges related to expedited orders, such as rush printing or shipping, are non-refundable for defective products unless the carrier delivers a defective product or fails to deliver an order. Turnaround time and shipping options for reprinted orders vary due to available production capacity and are at Beyond Your Branding, LLC’s discretion. Turnaround time begins after receipt of final proof approval, which must be in written format. No verbal approvals will be accepted.

9. Customer Supplied Artwork: We are not responsible for any errors in the customer’s printing job if they order online using the beyondyourbranding.com virtual design tool. This includes, but is not limited to, typographical errors, incorrect dates, and other design flaws that were not caught by the customer prior to submitting their order for production.

10. Color Proof Accuracy: Due to differences in the way proofs are created versus the actual printed piece, color proofs may not match the final product exactly. While we strive for accuracy, slight variations in color can occur, and we are not responsible for these minor differences. Additionally, customer-supplied proofs are not calibrated to our printing presses, which can result in color discrepancies.

Production Standards

11. Artwork Adjustments: To ensure the highest quality of the final product, our production team may make adjustments to customer artwork. This may include changes to line spacing within the logo or design to prevent spaces from filling in, or in the case of embroidery, adjusting the thickness or entirely changing fonts as necessary to ensure text legibility. These types of adjustments are considered to be an industry standard and are necessary to ensure our clients receive the highest quality products.

12. Overruns and Underruns: Due to the nature of the production process, there may be a variance of +/-5% in the quantity of products delivered. This is considered an industry standard. While we always strive to ship the exact quantity ordered, requesting an exact quantity may require an additional charge.

Intellectual Property and Indemnity

13. Intellectual Property Rights: By placing an order with Beyond Your Branding, LLC, you assure that you have full rights to use any graphics, images, pictures, or other content provided to us for production. You confirm that your use of these materials does not infringe on any intellectual property rights, including copyrights, trademarks, or patents.

14. Indemnity: You agree to indemnify, defend, and hold Beyond Your Branding, LLC, its partners, affiliates, subsidiaries, and suppliers harmless from any liability, loss, claim, and expense related to your violation of these Terms and Conditions. You agree to defend, indemnify, and hold Beyond Your Branding, LLC harmless from any and all claims arising from the improper use of trademark, copyright, or other protected material.

Limitation of Liability

15. Limitation of Liability: Beyond Your Branding, LLC is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our products or services, or for the cost of procurement of substitute products or services.

Governing Law

16. Governing Law: These terms and any disputes arising from them will be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles.

Amendments

17. Amendments: Beyond Your Branding, LLC reserves the right to amend these Terms of Service at any time.

Right of Refusal

18. Right of Refusal: We reserve the right to refuse service or products to any person or organization.
